Florence Jobs - Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Florence Jobs platform, available at florencejobs.app (the "Platform"). The Platform is operated by Digital Staff Solutions Ltd (trading as Florence), a company registered in England and Wales ("Florence", "we", "us", "our").

By registering for or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Florence Jobs is a recruitment matching platform connecting job seekers in the UK care sector with care providers looking to hire permanent staff. We are not an employment agency or recruiter. We do not act on behalf of either job seekers or hirers in making introductions or employment decisions.

2. Definitions

In these Terms:

  • "Job Seeker" means an individual who registers on the Platform to find permanent employment in the care sector.
  • "Hirer" means a care provider, organisation or individual who registers on the Platform to find candidates for permanent roles.
  • "User" means any registered Job Seeker or Hirer.
  • "Profile" means the information a Job Seeker submits about themselves, including their experience, qualifications, availability and preferences.
  • "Credits" means the non-monetary tokens purchased by Hirers to access certain Platform features.
  • "Match" means a connection made between a Hirer and a Job Seeker via the Platform's matching functionality.
  • "Content" means any text, data, information or other material submitted to the Platform by a User.

3. Eligibility and Registration

To use the Platform you must:

  • be aged 18 or over;
  • be legally permitted to work in the UK (for Job Seekers) or to operate as an employer in the UK (for Hirers);
  • provide accurate, complete and up-to-date information when registering; and
  • keep your account credentials secure and not share them with others.

You are responsible for all activity that takes place under your account. Notify us immediately at hello@florence.co.uk if you suspect unauthorised use of your account.

We reserve the right to refuse registration or to suspend or terminate any account at our discretion, including where we believe a User has provided false information or violated these Terms.

4. Job Seekers

4.1 Free to use

The Platform is free for Job Seekers. We do not charge Job Seekers for creating a profile, receiving match requests or communicating with Hirers through the Platform.

4.2 Your Profile

You are responsible for the accuracy and completeness of your Profile. You must not misrepresent your qualifications, experience, right to work status or any other information. Providing false or misleading information may result in immediate account termination.

By creating a Profile, you grant Florence a non-exclusive, royalty-free licence to use your Profile information for the purpose of operating the Platform, including presenting your Profile to Hirers as part of the matching process.

Your Profile remains private. Personal contact details are not shared with a Hirer until you accept a match request from that Hirer.

4.3 Your control

You may update, pause or delete your Profile at any time. You decide whether to accept or decline match requests. Florence does not pressure or obligate you to accept any match, interview or role.

5. Hirers

5.1 Account and Credits

Hirers must register an account and purchase Credits to access certain features, including posting roles and sending match requests to Job Seekers.

Credits are purchased upfront. All Credit purchases are non-refundable once processed, including where Credits remain unused or where an account is subsequently closed or suspended. It is your responsibility to ensure Credits are the right fit for your needs before purchasing.

Credits have no cash value and may not be transferred to another account or organisation.

5.2 Hirer obligations

By using the Platform as a Hirer, you confirm that:

  • you are authorised to recruit on behalf of your organisation;
  • any roles posted are genuine permanent vacancies;
  • you will comply with all applicable employment, equality and data protection laws in your use of the Platform and in any recruitment process;
  • you will not use the Platform to collect personal data for any purpose other than legitimate recruitment for the roles you have posted; and
  • you will not discriminate against candidates on the basis of any protected characteristic under the Equality Act 2010.

5.3 Mutual matching

Job Seeker personal contact details are only shared with a Hirer once both parties have indicated a willingness to connect (a "Mutual Match"). You may not attempt to identify or contact a Job Seeker outside of the Platform prior to a Mutual Match.

6. The Platform and AI Matching

Florence Jobs uses automated technology, including AI-based matching algorithms, to suggest connections between Job Seekers and Hirers. These suggestions are based on information provided by Users and are intended to assist, not replace, the recruitment decisions of either party.

We make no guarantee as to the suitability, accuracy or quality of any match. Florence is a technology platform, not a recruiter. We do not assess, verify or endorse the suitability of any Job Seeker for any role, or the suitability of any Hirer as an employer. All hiring decisions remain entirely with the Hirer and all decisions about accepting roles remain entirely with the Job Seeker.

Florence does not verify the qualifications, right-to-work status, DBS status, references or employment history of Job Seekers. Hirers are solely responsible for carrying out all pre-employment checks required by law and by their regulators, including CQC, Care Inspectorate, RQIA and CIW as applicable.

7. Content and Conduct

You are solely responsible for Content you submit to the Platform. You must not submit Content that:

  • is false, misleading or fraudulent;
  • infringes any third-party intellectual property, privacy or other rights;
  • is offensive, defamatory, discriminatory or otherwise objectionable;
  • contains malware, viruses or other harmful code; or
  • violates any applicable law or regulation.

Florence reserves the right to remove any Content that breaches these Terms or that we consider inappropriate, without notice.

8. Intellectual Property

Florence owns all intellectual property rights in the Platform, including its design, software, databases and branding. Nothing in these Terms grants you any rights in the Platform beyond the limited right to use it in accordance with these Terms.

You retain ownership of the Content you submit. By submitting Content, you grant Florence a non-exclusive, worldwide, royalty-free licence to use, store and process that Content for the purpose of operating the Platform.

9. Privacy and Data

Your use of the Platform is subject to our Privacy Policy, available at florence.co.uk/privacy. By using the Platform you acknowledge and agree to the processing of your personal data as described in that policy.

Hirers who receive personal data about Job Seekers through the Platform act as independent data controllers in respect of that data. Hirers must handle such data in accordance with UK GDPR and the Data Protection Act 2018, and use it only for the recruitment purposes for which it was shared.

10. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, Florence excludes all warranties, representations and conditions, express or implied, including as to fitness for purpose, accuracy or availability.

Florence is not liable for:

  • the conduct, acts or omissions of any User, whether a Job Seeker or Hirer;
  • the outcome of any recruitment process facilitated through the Platform;
  • any loss of employment, revenue or opportunity arising from use of or inability to use the Platform;
  • any reliance placed on match suggestions or Platform content; or
  • any interruption, suspension or termination of the Platform.

To the extent that liability cannot be excluded, Florence's total aggregate liability to any User arising out of or in connection with these Terms or use of the Platform is limited to the greater of: (a) the amount paid by that User to Florence in the 12 months preceding the relevant claim; or (b) £100.

Nothing in these Terms limits Florence's liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

11. Third Party Links and Services

The Platform may contain links to third-party websites or services. Florence has no control over and accepts no responsibility for those sites or services. Links do not constitute endorsement.

12. Changes to These Terms

Florence may update these Terms from time to time. We will notify registered Users of material changes by email or by a notice on the Platform. Continued use of the Platform after the effective date of any updated Terms constitutes acceptance of those Terms. If you do not accept the revised Terms, you should stop using the Platform.

13. Suspension and Termination

Florence may suspend or terminate your account at any time, with or without notice, where we reasonably believe you have breached these Terms or where we cease to operate the Platform.

You may close your account at any time by contacting hello@florence.co.uk. Closure of a Hirer account does not entitle you to a refund of any unused Credits.

On termination, all licences granted under these Terms cease immediately. Provisions that by their nature should survive termination will continue to apply.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. General

If any provision of these Terms is found to be unenforceable, that provision will be severed and the remaining provisions will continue in full force.

Florence's failure to enforce any right under these Terms does not constitute a waiver of that right.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Florence in relation to your use of the Platform.

These Terms are personal to you. You may not transfer or assign any rights or obligations under these Terms without our prior written consent.
